New Mexico Construction Industries Division (CID), after City of Española Planning & Land Use zoning approval
The city's Planning and Land Use Department grants zoning approval and a site development permit; the building permit is then obtained from the state Construction Industries Division, which the city also points to for construction code questions. Land outside the city limits falls under Rio Arriba County or Santa Fe County.

- Who issues the building permit
- The City of Española says building permits require zoning approval by its Planning and Land Use Department, after which the owner contacts the New Mexico Construction Industries Division to obtain the building permit. The city refers construction code questions to CID.
- Site development permit
- A land use or site development permit is required before developing property in the city, including building a new home, adding square footage, placing a manufactured home, carport, fence or accessory structure, and making utility connections. The city requires a site plan for every project that needs a permit.
- Zoning and design review
- The Planning and Land Use Department maintains the city's land use code and zoning map. Its fee schedule, adopted by Ordinance 2019-04, lists Historic District Review and Residential Development Permit among the application types.
- Outside the city on the Santa Fe County side
- Santa Fe County's development code and permits apply outside the incorporated areas of Santa Fe, Edgewood and Española, so parcels just past the city limits on that side answer to the county's Sustainable Land Development Code.
- Energy code climate zone
- The state's 2021 residential energy code (14.7.6 NMAC) lists Española at 5,643 feet in climate zone 5B.
- Septic permits
- Where a lot is not on sewer, the on-site system is permitted by the New Mexico Environment Department; its regulations page says Bernalillo County is the only county with its own onsite wastewater ordinance.

Building on land near Española
On valley land near Española, check the lot's width, flood status and road access before sizing a building. A wide gable shop may not fit a lot that suits a narrower plan. Inside the city, ask whether water and sewer reach the lot; beyond them, a domestic well needs a State Engineer permit and a septic system needs an Environment Department permit before the house is permitted. Metal building homes and pole barn homes both suit the valley, provided the site plan the city asks for shows setbacks, parking and the whole footprint.
